SeaData is the trade name under which this service is offered by a sole proprietorship established in the Netherlands, registered with the Netherlands Chamber of Commerce under number 17225840, hereinafter “SeaData”, “we” or “us”.

These terms apply to any use of the website seadata.online, the associated software including the client application, and all data and services offered through it, together “the Service”. By creating an account or using the Service you accept these terms.
The Service is offered exclusively to parties acting in the course of a profession or business. It is not intended for consumers.
When creating an account you declare that you act in the course of a profession or business. If that declaration proves incorrect, we may terminate the account.
An account is intended for one vessel. A fleet account provides access for a maximum of five vessels.
A fleet account may only be used for vessels belonging to, or operated by, the same company as the one with which the account was created. Sharing an account with another company, in any form, is not permitted.
The data for each linked vessel is separate. Removing a vessel from the account removes the link; the number of slots on the account remains unchanged.
We may change the number of vessels per account for future accounts. If a fleet account appears to be used for vessels of another company, we may terminate the account in accordance with article 1.1.
SeaData provides calculated and compiled information supporting maritime planning and situational awareness. The user remains responsible for assessing whether the data is suitable for their application. We do not verify the accuracy of data obtained from third parties (article 7).
The Service is not a navigation aid and must not be used as one. The data:
The master remains responsible at all times for the safe navigation of the vessel and must rely on official, current and certified sources.
Tidal predictions are astronomical: they compute the water level resulting from the positions of the moon and sun. They do not include surge caused by wind, air pressure or river discharge. Actual water levels may therefore differ considerably — during a storm on the Dutch coast by metres.
Where the Service indicates per port whether data is based on a measured tide gauge or on an ocean model, that distinction is informative. Model values are less accurate in ports, estuaries and rivers. Tidal heights are given relative to the reference datum stated for the port and are not directly comparable to the chart datum of a nautical chart.
AIS data is transmitted by vessels themselves and collected by third parties. It is incomplete and delayed: not every vessel transmits AIS, not every transmission is received, and coverage depends on the provider's receiver network. Vessel name, type and destination are entered by the vessel itself and may be incorrect.
AIS information in the Service is not suitable for collision avoidance and does not replace a lookout, radar or certified AIS equipment on board.
Information on space weather and GNSS interference is indicative and obtained from public sources. It is no guarantee of the availability or accuracy of positioning.
Unless expressly stated otherwise, all times in the Service are shown in UTC.
An account is required. On registration you provide accurate and complete information and keep it current, declare that you act in the course of a profession or business, and accept these terms. We record which version of the terms you accepted.
The Service automatically checks whether the positions submitted with a single API key are physically possible, by comparing consecutive positions against the time elapsed between them. If that comparison indicates a rate of movement not achievable by a vessel, we treat it as an indication that the key is being used on several vessels at once.
In that case we may refuse the request, replace the key, suspend or terminate the account. You may object to such a measure via mail@seadata.online; we will then review it with human involvement.
An account not used for twelve months consecutively may be deactivated. You will be notified in advance at the e-mail address known to us, with the option to reactivate the account.
You use the Service in accordance with these terms and applicable law. It is not permitted to:
If you find a security issue, report it to us before disclosing it publicly. We respond to good-faith reports and will take no action against reporters who act carefully.
We make reasonable efforts to keep the Service available, but give no guarantee of uninterrupted availability, currency or freedom from error. The Service depends on external sources and networks that may fail or change their terms. We may carry out maintenance, temporarily restrict the Service, or change or discontinue parts of it.
Use of the Service is currently free of charge. We reserve the right to offer the Service commercially in whole or in part, announced in advance with reasonable notice. No rights for the future can be derived from past free use. Your use will never automatically continue on a paid basis without your express agreement to the paid terms.
The software, design, structure and compilation of the Service are and remain the property of SeaData or its licensors. You receive a non-exclusive, non-transferable and revocable right of use for the duration of your account, solely for the intended use. The underlying data remains subject to the rights of the respective source holders.
The Service combines data from external sources including Copernicus Marine Service (CMEMS), ECMWF Open Data, Open-Meteo, NOAA SWPC, TICON-4 (DGFI-TUM, CC-BY 4.0), FES/AVISO, AISStream.io, GPSJam and OpenStreetMap. The terms and licences of the respective source holder apply to that data.

To provide the Service we process personal data including your e-mail address, registration details, IP address, and data on your use of the Service such as requested positions, timestamps and the outcome of the shared-use check.
How we handle this, on what legal basis, how long we retain it and what rights you have is set out in our privacy statement, which forms part of these terms.
The Service is provided as is, without warranties of any kind, to the extent permitted by law.
We are not liable for damage arising from the use of or reliance on the data, including damage caused by incorrect, incomplete, outdated or unavailable data. This applies in particular to damage relating to navigation, manoeuvring, mooring, loading or discharging, or any other decision on board.
Our liability is in all cases limited to direct damage and to the amount you paid for the Service in the twelve months preceding the event causing the damage. Where the Service is provided free of charge, our liability is limited to €500 per event and per calendar year. Liability for indirect damage, including consequential loss, lost profit, lost savings, business interruption, damage to vessel or cargo, salvage costs, environmental damage and fines, is excluded.
Any claim lapses in any event twelve months after you became aware, or could reasonably have become aware, of the damage. These limitations do not apply in the event of intent or deliberate recklessness on our part, nor to the extent that the law mandatorily provides for liability.
You indemnify us against third-party claims arising from your use of the Service in breach of these terms.
The agreement is for an indefinite period. You may terminate your account at any time via your account page or via mail@seadata.online. We may terminate the agreement with reasonable notice, or with immediate effect in the event of a serious breach of these terms.
On termination your access ends. Data is deleted or anonymised in accordance with the periods stated in the privacy statement, subject to statutory retention obligations.
We may amend these terms. In the event of a significant change we will inform you in advance at the e-mail address known to us or through the Service. If you do not agree with the change, you may terminate your account before it takes effect.
These terms are governed by Dutch law. Disputes shall be submitted to the District Court of Oost-Brabant, sitting at 's-Hertogenbosch, the Netherlands, unless mandatory law designates another court.
If any provision is void or voidable, the remaining provisions remain in force and shall be replaced by a provision that most closely approximates the original intent.
